Ah, but you see it specifically says to 'preserve, protect, and defend' which could be interpreted as perpetuate the existence of the constitution, not necessarily execute the laws enumerated by the constitution. To that point, the oath doesn't distinguish between the constitution: paper document and the constitution: the law. So really, legally, he's upholding his oath. Maliciously.

probably thinks that peaceful, respectful Declaration of Independence is the constitution

Reminder that the supreme court ruled that mr president is above the law (or commits no crimes while in office, something like that). Expect the constitution to be deported next
