I don't think this is copyright at all... Pretty sure this is simple breach of contract.

Jimmy will claim that they haven't maintained the quality he expects (which may or may not be in contract). VDC is claiming that Jimmy hasn't produced enough advertisements for it (which may or may not be in contract).

I don't think any of this is Copyright at all.
