Texas judge rules on case before hearing case.
We all know where this is going.
This was a motion to dismiss a fairly standard thing for a judge to rule on before a trial. The only effect of this ruling is that the case wasn't dismissed. And if it was dismissed at this stage it likely would have been done without prejudice. Meaning that they could just refile elsewhere.
Don't forget to mention this is a corrupt judge they specifically went to. He also owns Tesla stock, which is an obvious conflict of interest to anyone (except Republicans).

Under the federal code of judges' conduct, "a judge should recuse himself if a reasonable person in possession of the relevant facts would believe that the judge has reason for bias. And there is good reason to think that this rule covers O'Connor," [Harvard Law School Professor Noah] Feldman wrote. "Because Musk is so closely identified with both X and Tesla, Tesla share prices are arguably affected by the performance of X."
Feldman also said "the fact that Musk's lawyers appear to have sought a way to appear before O'Connor strengthens the case for recusal." X's claim that Texas is an appropriate venue because it has advertisers and users located in Texas is "meager, but perhaps less absurd than those used in some other forum-shopping situations," he wrote.
Yep, this is the judge that owns Tesla stocks and refused to recuse himself.

Source: I live in Texas. Well, ‘live’ is a kind way to say that I inhabit the state. It’s more like I just kind of exist there in perpetual anger and frustration.
Also in Texas because twenty years ago, my beloved wife HAD to have a house and there was no way in hell that was happening in California.
Today the wife is gone, the house is gone, the dogs are dead, and the daughter is grown and living in a far away civilized state that respects her right to exist.
And I'm still here. I pretty much don't leave the house anymore except to go to work and get groceries. So very, very tired of everything here, but no viable way out in the foreseeable future.
